Key Vote Analysis

This bill would have expanded the rights of individual property owners who became subject to provisions of the 1973 Endangered Species Act. The bill would have forced the government to compensate property owners if development plans were stymied by attempts to protect endangered species. It would also have given political appointees more power to make decisions about which species and areas would be subject to government intervention aimed at protecting plant and wildlife.

Proponents of the bill, which included many conservatives and westerners, said it would give property owners rightful protections. Opponents said it would weaken a bill that had led to successful protection programs for animals such as the Bald Eagle. The White House said it supported the bill but noted that the compensation of property owners could negatively impact the budget.

The bill moved onto the Senate where it "died" in committee in the fall of 2005.
